Terms and Conditions (Convenience Translation)

In the event of any discrepancies or differences in interpretation between this translation and the original German version, the German version shall prevail.
The contract language is German, and German law applies exclusively.
Part 1 – General Provisions
§ 1.1 General Information
Familyship is an online service operated by Familyship UG (haftungsbeschränkt), Rosenthaler Str. 72a, 10119 Berlin, Germany (hereinafter referred to as “Familyship”).
Familyship operates an online platform that enables people interested in topics related to family creation and family life to connect, communicate, and access supporting offers and information.
The platform may in particular include:
community areas for different life situations (e.g. family planning, family exchange), digital communication and interaction functions (e.g. profiles, messages), and additional online services such as information events or consultation sessions.
Familyship may expand, modify, or limit its range of services at any time within reasonable limits, provided that this does not unreasonably disadvantage users.
The current service descriptions are available on the website www.familyship.org.
The collection and processing of personal data are carried out in accordance with Familyship’s Privacy Policy, available at www.familyship.org/en/privacy.
§ 1.2 Liability
- Familyship is liable without limitation only for intent and gross negligence.
- In the case of slight negligence, Familyship is only liable if an essential contractual obligation (“cardinal duty”) has been breached. In such cases, liability is limited to the foreseeable, typical damage.
- These limitations of liability also apply in favor of Familyship’s employees and vicarious agents.
- Familyship strives to ensure high availability of its services. However, maintenance work, updates, or technical problems may lead to outages. There is no entitlement to a reduction or refund in such cases.
- Familyship is not liable for outages or performance disruptions due to force majeure. This includes, in particular, natural disasters, government actions, wars, civil unrest, pandemics, power outages, failures of communication networks or internet services, and cyberattacks despite adequate security measures. In such cases, there is no entitlement to compensation, reduction, or refund. This also applies to disruptions within the responsibility of third-party providers (e.g. hosting or payment service providers) for which Familyship is not responsible.
- Familyship is not liable for unauthorized access by third parties to personal data (e.g. through hacking), but takes appropriate technical and organizational security measures.
- Familyship assumes no liability for unlawful conduct by users.
- For damages not covered by the above paragraphs, Familyship is liable only in cases of intent or gross negligence.
- The above limitations of liability do not apply to claims arising from injury to life, body, or health.
§ 1.3 Indemnification
The customer shall indemnify Familyship against all third-party claims arising from content posted by the customer. This includes, in particular, claims based on copyright infringements, violations of personality rights, or other legal violations.
The customer shall bear all reasonable costs of legal defense arising from such claims, unless the customer is not responsible for the infringement.
§ 1.4 Consumer Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/.
Familyship is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 1.5 Right of Withdrawal (Widerrufsbelehrung)
Right of Withdrawal
Consumers have the right to withdraw from a paid contract concluded with Familyship within fourteen (14) days without giving any reason (§355 German Civil Code – BGB).
The withdrawal period is fourteen days from the date of contract conclusion.
To exercise the right of withdrawal, it is sufficient to send a clear declaration (e.g. by email to info@familyship.org).
The withdrawal period is deemed observed if the declaration is sent before the period expires. The customer bears the burden of proof for timely dispatch.
Consequences of Withdrawal
In the event of a valid withdrawal, Familyship will refund all received payments within fourteen (14) days after receipt of the withdrawal notice using the same payment method used in the original transaction.
If the customer has requested that Familyship begin providing services before the withdrawal period expires, the customer must pay Familyship an appropriate amount corresponding to the portion of services already provided up to the time of withdrawal compared to the total scope of the contractually agreed services (§ 357 (8) BGB).
§ 1.6 Final Provisions / Miscellaneous
- Familyship reserves the right to amend these Terms and Conditions if this becomes necessary due to legal, technical, or economic developments and does not unreasonably disadvantage the customer.
- Familyship will inform customers of any changes in a timely manner. If the customer does not object within six weeks after receiving the notification, the changes shall be deemed accepted. This does not apply to changes affecting essential contractual obligations (e.g. service content or prices).
- Declarations may be made via email.
- Familyship is entitled to engage third parties in the performance of its services, provided this does not disadvantage the customer.
- Should any provision of these Terms be invalid, the remaining provisions shall remain unaffected.
- German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance and jurisdiction is Berlin, Germany.
Part 2 – Special Conditions for the Use of the Communities
§ 2.1 General Conditions
(1) Registration and Conclusion of Contract
To use the full functionality of the platform, registration is required.
In the Family Planning Community, a paid membership package must also be booked.
The Family Community is currently free of charge. Familyship reserves the right to introduce fees for specific or future services.
Familyship will inform users in advance before any paid usage begins.
Existing customers will have the option to accept the paid usage or terminate their membership free of charge.
Requirements for registration:
- The user must be of legal age and act as a natural person.
- Use is permitted only for private purposes.
- Only one account per person is allowed.
- Accounts are non-transferable.
- All information provided must be truthful and complete.
- Passwords must be kept confidential.
§ 2.1.1 Purpose of the Contract
Familyship provides a platform that allows registered users to create profiles, view other profiles, and send private messages.
Familyship does not provide matchmaking services in the legal sense and assumes no responsibility for the establishment of contacts or agreements between members.
§ 2.1.2 Termination / Deletion of Account
Membership may be terminated at any time without giving reasons.
Deletion can be performed independently via the user account.
Familyship may delete or block an account if:
- legal or contractual obligations are violated,
- registration requirements are not met,
- the account has been inactive for more than 12 months, or
- legitimate interests justify termination.
Upon deletion, personal data will be deleted in accordance with the applicable data protection regulations, unless legal retention obligations apply.
§ 2.1.3 Responsibility for Content
Users are solely responsible for the content they post.
Familyship generally does not pre-screen content and assumes no responsibility for the identity or accuracy of other users’ profile information.
Violations may be reported through the “Report” function within the community or by email to info@familyship.org.
§ 2.1.4 Obligations of the Customer
Customers are obliged to comply with applicable laws and respect the rights of third parties.
In particular, customers must not:
- post illegal, offensive, or discriminatory content,
- use pornographic, violent, or harmful content,
- use copyrighted materials without authorization,
- harass or threaten other users,
- use automated programs to extract data,
- share or disclose private messages or emails,
- use Familyship for commercial or advertising purposes.
Violations may result in warnings, account suspension, or deletion.
§ 2.1.5 Liability
Familyship assumes no liability for inaccurate profile information or the success of user interactions.
Familyship is not liable for the misuse of information by other users.
§ 2.2 Special Conditions for the Family Planning Community
Familyship offers paid membership packages in the Family Planning Community.
Current prices and service descriptions are available on www.familyship.org.
Familyship provides only the technical platform and does not guarantee the success of any contact or cooperation between users.
Online consultation sessions may be offered as an optional additional service. There is no entitlement to participation.
Familyship may adjust the scope of services at any time, provided such changes are reasonable and do not disadvantage users.
§ 2.3 Special Conditions for the Family Community
Membership in the Family Community is currently free of charge and unlimited in duration.
Familyship provides technical features for networking and experience exchange.
Familyship assumes no responsibility for mediation, success, or the course of contacts.
Familyship reserves the right to introduce fees for certain or expanded functions in the future.
In such cases, Familyship will inform affected users in advance before any paid usage begins.
Continued use after notification shall be deemed consent to the introduction or modification of fees, unless the customer objects within the specified period.
Part 3 – Special Conditions for Participation in Online Consultation Sessions
§ 3.1 Scope
These conditions apply to the booking and participation in online consultation sessions offered by Familyship UG (haftungsbeschränkt).
§ 3.2 Registration
Registration takes place via www.familyship.org.
Bookings are processed in the order of receipt.
After payment, participants will receive access details via email.
Familyship may cancel an online session if the minimum number of participants is not reached.
§ 3.3 Participation Fee
The participation fee is specified on the website and must be paid prior to the session.
§ 3.4 Execution and Cancellation by Familyship
Familyship may cancel or reschedule online sessions for important reasons (e.g. illness of the presenter, low participation).
Any participation fees already paid will be refunded in full.
Further claims are excluded unless the cancellation is due to intent or gross negligence.
Online sessions serve informational purposes only and do not constitute medical, psychological, or legal advice in individual cases.
§ 3.5 Withdrawal by the Participant
- A withdrawal is possible up to five (5) days before the scheduled session. The period is calculated in calendar days and ends five days before the start of the session. Cancellations can be made via the cancellation link in the confirmation email or alternatively by email to info@familyship.org.
- In the case of a timely withdrawal:
- If the session is part of a paid membership package or the “Family Planning Compass” program, the cancelled session will be credited back to the customer’s account. A refund will not be issued in these cases.
- If the session was purchased individually, the participation fee will be refunded in full upon request. Alternatively, the participant may choose another session.
- If the withdrawal is not made in time or if the participant does not attend, the right to participate expires. No refund or credit will be granted.
- If there is a significant change in the time or content of the session, the participant has the right to withdraw within one week after receiving notice. In such cases, the participation fee will be refunded, or the session will be re-credited.
- Statutory withdrawal rights remain unaffected.
